1. Who we are and what these terms of service cover
AlgoKhaleej is a trading software development service run by Ilyas Kazi, a freelance developer based in India who serves traders in the GCC. These terms of service apply to every quote, spec, build, delivery and support period between AlgoKhaleej (“we”, “us”) and you, the client.
When you approve a quote or pay a deposit, you accept these terms of service. If a written quote or a signed agreement says something different, that document wins for that project.
2. Software development services only
We build software to your instructions: Expert Advisors, indicators, scripts, Pine Script tools, bridges, signal copiers, trade copiers, risk tools, code conversions and broker API automation.
We do not provide investment advice, trading signals, account management, fund management or brokerage services. We make no promise of trading results. A signal copier copies signals from sources you already have access to, and we never sell or provide signals.
3. Quotes and written specs
Every project starts with a written spec. It lists the rules, inputs, limits, platforms and files you will receive. You approve it in writing, and a clear “yes” on WhatsApp or by email counts.
The quote follows the approved spec. It states the price in USD, the delivery date and what the delivery includes. Work outside the spec is a change request. We quote each change request first, and we start it only after you agree. A change can also move the delivery date.
4. Prices and payments
All prices and invoices are in US dollars. Unless your quote says otherwise:
- you pay a deposit of [DEPOSIT %] of the quote before coding starts,
- you pay the balance after you approve the demo build and before we release the full version,
- larger projects may use milestones, with one payment for each approved stage.
We accept [PAYMENT METHODS]. Your bank or payment provider may charge its own fees or convert the amount into your local currency. We start coding once we receive the deposit.
5. Trial builds, testing and acceptance
Before the final payment, we send a trial build for testing. We may lock a trial build to the trading account number you give us, and we may set an expiry date on it. Use a trial build only on a demo account.
You have [X] days from receiving each build to test it and report anything that does not match the approved spec. We fix those points and send a new build. A build counts as accepted when you confirm it in writing, or when the testing window ends without a report of a mismatch.
6. Delivery, fixes and support
After the final payment, we deliver the full version: the compiled file (for example .ex4, .ex5 or a script), a settings guide and a setup call. If you bought the source code, we deliver it at the same time.
For [X] days after delivery, we fix, at no extra cost, any part of the software that does not work as the approved spec describes. This support window does not cover new features, new strategies or changes to your rules. It also does not cover problems that come from changes by your broker, platform, VPS or other third parties. We quote that work separately.
7. Intellectual property
Your strategy stays yours. The trading rules, ideas and settings you give us belong to you, and we do not reuse or sell them.
After the final payment, you receive a licence to use the compiled file for your own trading, on the accounts you control. You may not resell, share or publish the compiled file unless we agree in writing.
Source code is a separate purchase. If you buy it, you receive a copy that you may edit and compile for your own use. Your quote states whether you may also resell or share it. Without that purchase, the source code stays with us.
We keep the right to reuse general code that is not specific to your strategy, such as order handling, logging or panel functions.
8. Confidentiality and NDA
We keep your rules, files and messages confidential. On request, we sign a non-disclosure agreement (NDA) before you share the details. We never show your project, your name or your results in our portfolio without your written consent.
9. No investment advice
Nothing we write, code or say is investment advice. Default values in a settings guide are examples for testing, not recommendations. You decide whether, what, when and how much to trade.
10. Your responsibilities
You are responsible for:
- giving us complete and accurate rules,
- checking your broker’s terms, your local regulations and any prop firm rules before you use a tool,
- your terminal, VPS, internet connection and platform accounts,
- testing every build on a demo account before any live use,
- every decision to use the software on a live account, and the results of that use,
- keeping your account passwords private, since we never need them.
11. Limitation of liability
We build the software to the approved spec, and we test that it works as described. However, trading carries a substantial risk of loss. We are not liable for trading losses, missed trades, slippage, requotes, broker rejections, platform outages, data feed errors, VPS or internet failures, or any decision you make with the software.
To the extent the law allows, our total liability for any project is limited to the amount you paid us for that project. Nothing in these terms of service limits a liability that the law does not allow us to limit.
12. Third-party platforms
Our tools run on platforms we do not control, such as MetaTrader 4, MetaTrader 5, TradingView, Telegram, WhatsApp, broker APIs and VPS services. Their owners can change their software, rules, APIs or prices at any time, and such changes can stop a tool from working. After the support window, we treat updates for those changes as new work and quote them first.
13. Ending a project
You can end a project at any time by telling us in writing. We can also end a project if you do not pay an invoice, if you ask for something unlawful or against platform rules, or if you break these terms of service. Our refund policy explains what happens to payments when a project ends. Sections 7 to 11 still apply after a project ends.
14. Governing law
These terms of service follow the laws of [JURISDICTION]. If a dispute arises, we first try to solve it together in good faith. If that fails, the courts of [JURISDICTION] decide.
15. Changes to these terms of service and contact
We may update these terms of service from time to time. The version in force when you approve a quote applies to that project. For questions, email support@algokhaleej.com or message us on WhatsApp at +91 91066 42985. See also our privacy policy and disclaimer.
